Copyright & Takedown Policy
1. Introduction to Copyright & Takedown
EU Trace respects intellectual property rights and expects its users to do the same. This Copyright and Takedown Policy explains how Kairosys GmbH handles reports of alleged copyright infringement on the EU Trace platform in accordance with applicable German and European Union law, particularly the German Act on Copyright (UrhG) and the EU Directive on Copyright in the Digital Single Market (2019/790). This policy applies to all content hosted on or transmitted through the EU Trace API, website, and related services.
2. Copyright Policy and Principles
All intellectual property on EU Trace — including SDKs, documentation, JSON mapping specifications, trademarks, logos, and website content — is owned by Kairosys GmbH or its licensors and is protected by copyright law. Users retain ownership of data and content they submit to the API, but may not upload, store, or distribute material that infringes on the rights of third parties. Unauthorized reproduction, distribution, or modification of protected content is prohibited under §§ 15ff. UrhG. Kairosys GmbH will respond to clear notices of alleged copyright infringement in compliance with applicable safe-harbor provisions.
3. Submitting a Takedown Notice
If you believe in good faith that material available on EU Trace infringes your copyright, you may submit a written notice to our designated contact. To be effective, your notice must include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the infringing material and information reasonably sufficient to locate it; (c) your name, address, telephone number, and email address; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature. Notices that do not substantially comply with these requirements may be disregarded. Pursuant to § 97a UrhG, we may request a declaration of costs if a notice is manifestly unfounded.
4. Counter-Notice
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice. Your counter-notice must include: (a) identification of the material that was removed and the location where it appeared before removal; (b) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; (c) your name, address, telephone number, and email address; (d) a statement consenting to the jurisdiction of the courts in Frankfurt am Main, Germany; and (e) your physical or electronic signature. Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not initiate legal proceedings within 14 business days, we may restore the material.
5. Repeat Infringer Policy
Kairosys GmbH reserves the right to suspend or terminate the accounts of users who are repeat infringers of copyright or other intellectual property rights. A repeat infringer is a user who has been the subject of more than one valid takedown notice. We also reserve the right to remove allegedly infringing material and terminate accounts at our discretion, even for a single instance of egregious infringement. This policy is consistent with the liability limitations set forth in § 512 of the German Telemedia Act (TMG) and applicable EU law.
6. Enforcement and Cooperation
Kairosys GmbH cooperates with law enforcement and regulatory authorities in investigating potential copyright violations. This policy is governed by the laws of the Federal Republic of Germany as set forth in our Terms and Conditions. Any disputes arising from takedown or counter-notice procedures shall be resolved in the courts of Frankfurt am Main, Germany. We reserve the right to modify this policy at any time, with changes effective upon posting to this page.
